Terms of Service

1. Service provider and contact
Fitibook is operated by Kreokracja Piotr Dębowski, ul. Jaworowa 12/e, 32-020 Wieliczka, Poland, tax identification number (NIP) 6782805932, the “Operator”. For website and app support, contact hello@fitibook.pl or +48 507 018 061. Help is available at fitibook.pl/en/informacje/pomoc.
2. Website and apps
These Terms cover the Fitibook platform, including the website, customer app and tools used by independent clubs and studios (“Businesses”). Fitibook provides public profiles, schedules and news, customer accounts, bookings for classes and available sports facilities, waitlists, passes, balances, history, notifications and profile settings. Features depend on the Business’s offer, platform and app version.
Downloading the customer app and creating and maintaining a customer account are free. Charges for classes, passes and other Business services are separate. Check the price, payment method and conditions before ordering. Internet access costs follow the User’s agreement with their provider. Paid access to Business tools is governed by the Business’s separate offer or agreement with the Operator.
3. The Operator and Businesses
The Operator maintains the technology platform. The Business identified in an offer provides its own services and is responsible for descriptions, prices, schedules, staff, premises, participation requirements, passes and settlements. The User contracts with that Business for classes or passes unless the offer expressly says otherwise. Providing booking or payment tools does not make the Operator the organiser or seller of the Business’s service.
Passes, credits, sports cards and balances follow the rules of the relevant Business and do not automatically entitle the User to services at another Business. News and training advice are informational and are not a diagnosis or individual medical advice. The organiser sets lawful age, health and participation requirements. A person without full legal capacity uses services with the involvement or consent of their legal representative where required.
4. Technical requirements and accounts
Use requires Internet access and a current browser supporting HTTPS and necessary cookies, or a compatible device meeting the requirements shown in the app store. An account requires the information marked mandatory in the form and access to the email address used for registration or account recovery. Verification follows the current instructions in the form. Providing a telephone number does not itself verify it.
The User provides current information, accepts these Terms and reads the Privacy Policy. Accepting account documents is not marketing consent. One account can be used with multiple Businesses, while information and entitlements at a Business remain connected to its services. A profile may contain an optional photo and date of birth.
Users must protect passwords, verification codes and devices and report suspected account compromise. Face ID, Touch ID or other biometrics, where available and enabled, protect access locally; the Operator does not receive biometric templates. Support never requires sending a password, sign-in code or payment-card details.
5. Bookings, waitlists and sports cards
Before confirming, check the date, location, availability, price or required entitlement and cancellation conditions. Depending on Business settings, a booking may be free, use a pass or balance, accept a sports card, be payable on site or offer online payment. Availability and conditions are checked again when the booking is made. The booking status on the account confirms a place; starting a booking or payment alone does not.
A waitlist entry does not guarantee a place. Promotion rules depend on Business settings; successful allocation is shown by the booking status. Users should check their bookings even if they do not receive notifications.
Saving a sports card in the wallet does not replace verification by the Business or card provider. Accepted variants, surcharges, limits and presentation requirements follow the offer and provider’s rules. A booking QR code identifies the booking and should not be shared publicly.
6. Online payments, balances and refunds
Fitibook supports PayU payments at Businesses that have connected, verified and enabled the service. Depending on the offer, a prepayment, full booking payment or top-up of a balance at that Business may be available. The absence of online payments at a Business does not mean all its services are free.
Payment takes place on a PayU page or form, including when it opens inside the app. The payment service provider is PayU S.A., based in Poznań, Poland. PayU displays available methods and payment-service terms during checkout. The amount and currency are shown before confirmation. The payment relates to the selected Business and is settled through its PayU account. Fitibook does not operate a bank account for the User and does not store full card numbers or CVV/CVC codes.
A pending payment may temporarily hold a place. Returning from PayU does not confirm payment; the status updates after verification. After an interrupted payment, check your account history before paying again. If payment is confirmed but a booking cannot be created, the system requests a refund. The time for funds to arrive also depends on PayU and the payment-instrument provider.
A balance records funds for settlement with a particular Business. Funds may be held for a booking and then settled under the offer’s conditions. A balance top-up and payment for a specific booking are separate transactions. The relevant Business handles the use and refund of unused balances or passes, subject to statutory rights.
7. Cancellation and consumer rights
The free-cancellation deadline and consequences of late cancellation or absence are shown with the booking. Open the relevant booking in your account to cancel. Timely cancellation releases the place and the corresponding entitlement or balance hold under the booking conditions. Online-paid bookings trigger the applicable refund process. Late cancellation may consume a credit or result in an amount being retained only under lawful conditions properly disclosed before ordering.
When a Business cancels a class, it must settle the unprovided service. If an automatic refund requires attention, this may be shown in the customer account or Business panel. Contact the Business in that case. A technical error does not remove an obligation to make a due refund or the User’s statutory rights.
Contractual booking cancellation is separate from statutory withdrawal. As a general rule, consumers may withdraw from a distance contract within 14 days, subject to statutory exceptions. An exception may apply to leisure services or sporting events provided on a specified date or during a specified period. It does not automatically remove withdrawal rights for every pass or offer. Each Business must provide the information applicable to its service before an order. Withdrawal from an account agreement can be notified to the Operator; the account can also be terminated at any time under section 10.
8. Notifications and marketing
Fitibook provides account messages, service emails, push notifications and local reminders where enabled on the device. These may concern bookings, class changes, waitlists, passes and other account events. App and device settings affect delivery. Messages may be delayed or undelivered; check the current status in the account. SMS sending is not currently an active Fitibook channel.
Operator or Business newsletters and promotions are separate from messages necessary to run accounts and bookings. Marketing contact requires appropriate prior consent. Consent can be refused or withdrawn without losing account access. For Operator marketing, contact hello@fitibook.pl; for Business messages, also contact the sender directly. Use an unsubscribe mechanism in a message where provided. System permission for notifications does not replace marketing consent.
9. Content, reviews and reports
Businesses are responsible for the lawfulness of their photos, descriptions, news and staff information. Users may publish only content they have the right to use and that does not infringe others’ rights. Publishing this document does not establish rights to specific materials supplied to the Operator by others.
Posting a review of a place is linked to confirmed attendance at a completed class. This verifies an account’s connection to the service, not every statement in the review. Unlawful content, impersonation, unjustified disclosure of others’ data, harassment, circumventing security and disrupting the platform are prohibited.
Report inappropriate content or rights infringements to hello@fitibook.pl, identifying the publication, issue and a reply contact. The Operator assesses reports, may request clarification and may restrict or remove content to the extent justified by law and these Terms. Decisions are communicated as required by law. Objections can be sent through the same channel. A report does not require a password.
10. Termination and account deletion
Global customer account deletion is available in the app under Account → Delete account, and on the website under Account → Account settings → Delete account. Information and access to this feature are also at fitibook.pl/en/konto/usun. Assistance is available at hello@fitibook.pl. The feature requires confirmation and the current password; the Operator may appropriately verify identity when handling a support request.
Deletion ends customer access across linked Businesses, invalidates sessions, removes or replaces profile data and removes the photo association. Active future bookings and waitlist entries are cancelled under their applicable conditions. Removing the app from a device does not delete the account. Customer account deletion does not delete a separate staff or Business-owner account.
Before deletion, check passes, balances, pending payments and bookings and retain needed confirmations. Deleting an account is not an automatic request to refund the entire balance, does not waive debts and does not remove records needed for settlements or protection of rights. The Privacy Policy explains the remaining data.
11. Availability, complaints and liability
The Operator exercises due care to maintain a secure platform and provides necessary updates. Technical interruptions may occur; significant planned interruptions are announced in advance where possible. Nothing excludes non-waivable liability or consumer rights, including rights concerning conformity of a digital service with the contract.
Send Fitibook complaints to hello@fitibook.pl or the Operator’s postal address. Include a description, date, booking reference, app version and requested outcome where available. The Operator answers consumer complaints within 14 days unless another statutory period applies. Complaints about class quality, passes, prices or Business settlements should also be sent to the Business. Assistance from the Operator does not remove claims against the responsible party.
12. Data, document updates and governing law
The Privacy Policy explains data, purposes, recipients, retention and individual rights. Documents are available in Polish and English. This edition updates information about available features, payments, notifications and account termination. It does not retroactively change prices or existing booking conditions and does not grant marketing consent on behalf of a User. Publication alone does not mean existing account holders accept new obligations.
Material changes to an existing agreement are communicated sufficiently in advance to allow Users to review them and stop using the service if they do not accept. Changes do not prejudice acquired rights or mandatory law. Polish law applies without depriving consumers of protection under mandatory provisions of their habitual-residence country. Disputes may be brought before a competent court or addressed through available consumer alternative dispute resolution procedures.
13. Fitibook Klub staff application
Fitibook Klub is a tool for owners, managers, reception staff and instructors of Businesses using Fitibook. Access requires an individual staff account with permissions for the relevant Business. A customer account in Fitibook does not automatically grant staff permissions. The club app does not provide self-service account registration or the purchase of software subscriptions. The Business's cooperation with the Operator remains subject to separate arrangements.
Available functions depend on the staff role and Business configuration. They may include class and court schedules, participant lists, attendance, booking-code scanning, customer profiles, pass assignments, balance records, notes and club settings. Recording a settlement does not itself confirm a bank transfer or constitute a fiscal receipt. The Business is responsible for its information, offers, settlements and staff authorizations.
Staff may process customer data only within their duties and assigned permissions. Accounts must not be shared with unauthorized persons, and unnecessary data must not be entered. Notes shared with a customer may be visible to that customer; check the recipients before saving. Documents and information entered by a Business do not replace its obligations to customers or a data processing agreement where one is required.
Sign-in requires a password and additional verification. Optional Face ID or Touch ID protects the saved session on the device. Signing out or uninstalling does not delete Business records. Staff can ask their Business administrator to end their access. Requests to delete data or end cooperation with Fitibook can be submitted using Contact in the app or hello@fitibook.pl. Identity and authority are verified before a request is acted on; any retained records depend on the obligations of the relevant controller.
The contact form is also available before sign-in. It requests a name, email address, topic and message to handle an enquiry. Marketing consent, an email app, passwords and verification codes are not required.
